TERMS & CONDITIONS

These Terms & Conditions (“Terms”) apply to junk removal, dumpster rental, hauling, cleanout, debris removal, and related services provided by Pro Haul Systems LLC (“Pro Haul Systems,” “Company,” “we,” “us,” or “our”).

By accepting a quote, signing an agreement, approving work electronically, scheduling service, making payment, accepting delivery of a dumpster, or otherwise authorizing Pro Haul Systems to perform services, the customer (“Customer,” “you,” or “your”) acknowledges and agrees to these Terms.

Effective Date: 5/10/2025

1. QUOTES & PRICING

Quotes are based on the information, photographs, descriptions, estimated volume, materials, accessibility, labor requirements, and other information provided before service.

Pricing may change if the actual conditions differ from those represented when the quote was prepared, including changes in:

  • Volume of material

  • Weight of material

  • Type of material

  • Labor required

  • Stairs or elevators

  • Carrying distance

  • Difficult or restricted access

  • Equipment requirements

  • Disposal requirements

  • Scope of work

 

When reasonably possible, Pro Haul Systems will notify the Customer of material price changes before performing additional work.

 

2. PAYMENT

Unless otherwise agreed to in writing, payment is due upon completion of junk removal services or upon delivery of a dumpster.

Commercial customers with approved payment terms must pay according to the terms shown on their invoice or agreement.

The Customer is responsible for all authorized charges associated with the service, including applicable rental charges, disposal overages, additional rental days, special-material charges, overfill charges, additional labor, trip charges, swap-outs, and other charges permitted under the applicable quote or agreement.

 

3. CREDIT/DEBIT CARD ON FILE

When the Customer separately provides a payment method and authorizes Pro Haul Systems to keep it on file, the Customer authorizes charges permitted by that payment authorization and the applicable service agreement.

Potential post-service charges may include documented:

  • Excess disposal weight

  • Additional rental days

  • Overfill charges

  • Special disposal charges

  • Mixed-load charges

  • Empty-and-return or swap-out services

  • Additional labor

  • Other agreed service charges

Where practical, supporting documentation such as landfill weight tickets may be provided for weight-related charges.

These Terms do not by themselves replace any separate payment or card-on-file authorization required by Pro Haul Systems or its payment processor.

 

4. JUNK REMOVAL PRICING

Junk removal pricing may be based on truck/load volume, individual items, labor, weight, disposal requirements, or a combination of these factors.

Standard volume-based pricing may include:

  • Single Item – starting at $120

  • 1/4 Load – $175

  • 1/2 Load – $295

  • 3/4 Load – $395

  • Full Load – $495

Prices are subject to the actual materials, weight, labor, accessibility, and disposal requirements of each job.

Items or materials that are unusually heavy or require special handling may not qualify for standard volume pricing.

 

5. HEAVY ITEMS

Additional charges may apply to items requiring additional labor, equipment, personnel, or special handling because of their size or weight.

Examples may include safes, pianos, hot tubs, exercise equipment, oversized appliances, extremely heavy furniture, tile, concrete, masonry, and other dense materials.

Any applicable heavy-item charge will be determined based on the specific job.

 

6. STAIRS & DIFFICULT ACCESS

Additional charges may apply when removal requires additional labor because of:

  • Stairs

  • Elevators

  • Narrow hallways or doorways

  • Long carrying distances

  • Limited parking

  • Difficult terrain

  • Restricted access

  • Disassembly

  • Other unusual site conditions

The Customer should disclose known access issues before receiving a quote.

 

7. CUSTOMER PROPERTY & ITEMS TO BE REMOVED

The Customer is responsible for clearly identifying which property is to be removed and which property is to remain.

Before work begins, Customers should remove or secure cash, jewelry, medications, important documents, identification, electronics containing sensitive information, sentimental items, and other valuables they do not want removed.

Once an item has been loaded, transported, donated, recycled, transferred, or disposed of, recovery may be impossible.

Pro Haul Systems is not responsible for items mistakenly identified or reasonably presented to our crew as junk or debris for removal.

 

8. AUTHORITY TO REMOVE PROPERTY

The Customer represents that they own the materials being removed or have legal authority and permission from the property owner or other authorized party to have the materials removed.

The Customer agrees not to instruct Pro Haul Systems to remove property belonging to another person without proper authorization.

 

9. DUMPSTER RENTAL PERIOD

The rental period begins on the delivery date unless otherwise stated on the quote or agreement.

The applicable rental period and price will be shown on the Customer's quote.

Additional rental time is currently charged at $55 per additional day, unless another rate is stated in writing.

Extensions are subject to availability and should be requested before the scheduled pickup.

Pro Haul Systems does not guarantee that an extension will be available.

 

10. INCLUDED DUMPSTER WEIGHT

Unless otherwise stated on the Customer's quote, dumpster rentals include the first:

2,000 lbs (1 ton)

of disposal weight.

The final weight is generally determined by the disposal facility's scale or other applicable disposal documentation.

 

11. DUMPSTER WEIGHT OVERAGES

Weight exceeding the included 2,000 lbs is currently charged at:

$0.04 per additional pound

Example: If the disposal facility records a net load weight of 3,000 lbs, the Customer has 1,000 lbs of excess weight and may be charged $40 in weight overage.

Applicable disposal or special-material charges may be separate from the weight-overage charge when disclosed in the quote, agreement, or these Terms.

 

12. SPECIAL & MIXED MATERIALS

An additional $75 surcharge may apply to loads containing materials requiring special handling or disposal, including:

  • Pressure-treated wood

  • Food or wet waste

  • Mixed loads requiring disposal at a different facility

  • Other materials requiring special disposal procedures

Additional charges imposed by a disposal facility may also apply when disclosed or authorized under the applicable service agreement.

Customers should ask Pro Haul Systems before placing questionable materials into a dumpster.

 

13. PROHIBITED MATERIALS

Unless Pro Haul Systems gives prior written approval, dumpsters may not contain hazardous, regulated, illegal, explosive, flammable, toxic, infectious, or otherwise prohibited materials.

Examples may include:

  • Asbestos

  • Chemicals

  • Fuels

  • Oils

  • Paints or solvents

  • Propane tanks

  • Batteries

  • Medical or biohazardous waste

  • Explosives

  • Ammunition

  • Radioactive materials

  • Other hazardous or regulated waste

The Customer is responsible for disclosing questionable materials before loading them.

If prohibited materials are discovered, the Customer may be responsible for reasonable costs associated with identification, handling, removal, transportation, cleanup, disposal, regulatory compliance, or return of those materials, to the extent permitted by law.

 

14. DUMPSTER LOADING REQUIREMENTS

Materials must remain within the interior dimensions of the dumpster.

Nothing may extend above the top edge or protrude from the sides, front, or rear.

The load must be reasonably distributed and safe for transportation.

Pro Haul Systems may refuse to transport a dumpster that cannot be safely or lawfully hauled.

The Customer must correct unsafe loading conditions before transportation.

 

15. OVERFILL / TOP-OFF FEE

A $200 overfill/top-off fee may apply when materials are loaded above the top edge of the dumpster or otherwise create an unsafe load requiring additional handling.

Pro Haul Systems may require the Customer to remove excess material before pickup.

Additional labor, trip, or disposal charges may apply if Pro Haul Systems agrees to correct an unsafe or overfilled load.

 

16. MAXIMUM WEIGHT & OVERLOADED DUMPSTERS

The Customer may not load a dumpster beyond the safe or legal carrying capacity of our equipment.

Heavy materials such as concrete, dirt, roofing material, brick, stone, tile, and similar dense debris require prior approval.

If a dumpster is too heavy to safely or legally transport, Pro Haul Systems may refuse pickup until sufficient material is removed.

Additional trip, labor, equipment, or other reasonable charges may apply.

 

17. DUMPSTER EMPTY & RETURN / SWAP-OUT

If the Customer fills a dumpster and requests that it be emptied and returned during the rental period, an empty-and-return or swap-out charge may apply.

The current base service charge is $200, unless otherwise quoted.

Disposal weight, special-material charges, excess weight, or other applicable charges may be additional.

 

18. DUMPSTER PLACEMENT

The Customer is responsible for selecting and approving the requested dumpster placement location.

The Customer represents that they have permission to place the dumpster at that location.

Pro Haul Systems may refuse a requested placement if our driver believes it is unsafe, inaccessible, unlawful, or likely to damage equipment or property.

 

19. DRIVEWAYS & PROPERTY DAMAGE

Dumpsters and the vehicles used to deliver and retrieve them are heavy.

Although Pro Haul Systems will use reasonable care, the Customer acknowledges that placing or operating heavy equipment on driveways, pavement, pavers, asphalt, lawns, curbs, sidewalks, landscaping, or similar surfaces carries an inherent risk of cracking, sinking, rutting, scratching, staining, or other damage.

The Customer is responsible for selecting a suitable placement location and for identifying hidden or vulnerable conditions.

Nothing in these Terms is intended to waive responsibility that cannot lawfully be waived or to excuse damage caused by conduct for which liability cannot legally be limited.

 

20. UNDERGROUND & OVERHEAD CONDITIONS

The Customer must notify Pro Haul Systems of known underground or concealed conditions that could affect delivery or pickup, including:

  • Septic systems

  • Drain fields

  • Irrigation systems

  • Underground utilities

  • Drainage systems

  • Soft ground

  • Underground structures

The Customer should also identify overhead hazards such as low power lines, tree limbs, building overhangs, gates, and other obstructions.

Pro Haul Systems may refuse delivery or pickup when conditions appear unsafe.

 

21. PERMITS & PROPERTY RULES

Unless specifically agreed otherwise in writing, the Customer is responsible for determining whether a permit, HOA approval, landlord authorization, municipal approval, parking authorization, or other permission is required for dumpster placement or service.

Any fines, towing costs, penalties, permit fees, or similar expenses arising from the Customer's failure to obtain required authorization may be the Customer's responsibility to the extent permitted by law.

 

22. ACCESS FOR DUMPSTER PICKUP

The Customer must provide reasonable access to the dumpster on the scheduled pickup date.

Vehicles, gates, locked entrances, construction equipment, debris, or other obstructions must not prevent retrieval.

If Pro Haul Systems cannot retrieve the dumpster because access is blocked or conditions under the Customer's control prevent pickup, additional trip or rental charges may apply.

 

23. MOVING OR ALTERING OUR DUMPSTERS

Customers may not move, relocate, lift, tow, modify, paint, damage, or allow another company or individual to move a Pro Haul Systems dumpster without prior authorization.

The Customer may be responsible for damage resulting from unauthorized movement, misuse, or alteration.

 

24. DAMAGE TO RENTAL EQUIPMENT

The Customer is responsible for reasonable repair or replacement costs for damage to Pro Haul Systems equipment caused by misuse, unauthorized movement, vandalism by persons under the Customer's control, prohibited materials, fire, overloading, or other Customer-caused conditions beyond ordinary wear and tear.

 

25. SAME-DAY RUSH SERVICE

When available, priority same-day scheduling may be offered for an additional $65 rush-service fee.

Same-day service is subject to scheduling, equipment, staffing, traffic, disposal-facility hours, weather, and other operational conditions.

The rush fee is separate from the underlying service price.

Once Pro Haul Systems has scheduled and dispatched resources specifically for the rush request, the rush fee is non-refundable except where required by law or otherwise agreed by Pro Haul Systems.

 

26. EXTENDED SERVICE AREA

Services outside Pro Haul Systems' standard service area may be subject to an extended service-area charge.

The applicable fee will be disclosed on the quote or invoice.

An extended service-area charge is separate from dumpster rental, disposal, weight-overage, labor, and other applicable service charges.

 

27. CANCELLATIONS & RESCHEDULING

Customers should provide as much advance notice as possible when cancelling or rescheduling service.

A reasonable cancellation, trip, or dispatch fee may apply when a crew or equipment has already been dispatched, a dumpster has been loaded for delivery, or Pro Haul Systems incurs costs because of a late cancellation or conditions within the Customer's control.

Any applicable cancellation fee disclosed during booking or on the quote will control.

 

28. WEATHER & OPERATIONAL DELAYS

Service times are estimates and may be affected by weather, traffic, equipment issues, landfill or transfer-station delays, road closures, emergencies, unsafe site conditions, or other circumstances beyond Pro Haul Systems' reasonable control.

Pro Haul Systems will make reasonable efforts to communicate significant delays.

 

29. PHOTOS & DOCUMENTATION

Pro Haul Systems may photograph dumpsters, loads, debris, placement areas, access conditions, completed work, landfill tickets, or other job conditions for operational documentation, billing, dispute resolution, and quality-control purposes.

Any use of identifiable Customer property for advertising or promotional purposes will be handled separately from routine service documentation as appropriate.

 

30. UNPAID BALANCES

Customers are responsible for paying valid charges when due.

If an account becomes past due, Pro Haul Systems may suspend future service and pursue lawful collection methods.

To the extent permitted by applicable law and the Customer's agreement, the Customer may be responsible for reasonable costs associated with collecting an unpaid balance.

 

31. CHARGEBACKS & BILLING DISPUTES

Customers should contact Pro Haul Systems promptly regarding billing questions or disputed charges so that supporting documentation can be reviewed.

A chargeback does not automatically eliminate an otherwise valid payment obligation.

Pro Haul Systems may provide signed agreements, photographs, communications, landfill weight tickets, invoices, payment authorizations, and other relevant documentation to payment processors or financial institutions when responding to a payment dispute.

 

32. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pro Haul Systems will not be responsible for indirect, incidental, special, or consequential damages arising from the services.

Any limitation or exclusion contained in these Terms applies only to the extent enforceable under applicable law and does not exclude liability that cannot legally be excluded.

 

33. INDEMNIFICATION

To the extent permitted by law, the Customer agrees to be responsible for claims, losses, costs, or damages arising from the Customer's unauthorized disposal of property, placement of prohibited materials, lack of authority to remove property, violation of applicable laws or property rules, or material breach of these Terms.

This provision does not require the Customer to indemnify Pro Haul Systems for liability that cannot lawfully be shifted to the Customer.

 

34. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute regarding venue or jurisdiction will be handled according to applicable Florida law and any enforceable written agreement between the parties.

 

35. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

 

36. CHANGES TO TERMS

Pro Haul Systems may update these Terms periodically.

The version applicable to a service will generally be the version presented, linked, or otherwise made available to the Customer when the applicable service is booked or agreed upon, unless the parties subsequently agree otherwise.

 

37. ENTIRE SERVICE AGREEMENT

These Terms, together with the applicable quote, invoice, signed service agreement, payment authorization, and any written modifications accepted by both parties, constitute the terms applicable to the service.

If a specific written quote or signed agreement expressly conflicts with these general Terms, the more specific written provision will control for that service.

 

38. CUSTOMER ACCEPTANCE

By signing or electronically approving an agreement or quote, authorizing service, or accepting dumpster delivery after being provided these Terms, the Customer acknowledges that they have had an opportunity to review and accept the applicable Terms.
